DAJI Guidelines for Secondary Works
Establishment of Guidelines
Wwwave Corporation (hereinafter referred to as "Company") has established the following guidelines for derivative works of the DAJI Content provided by the Company, as defined below.
The purpose of these guidelines is to share specific rules between the Company and you so that you can engage in derivative creation activities related to "DAJI" with peace of mind, thereby creating a single entertainment community.
We appreciate your understanding and cooperation.
By creating derivative works of the contents as defined below, you are deemed to have agreed to these guidelines.
General
Definition of Derivative Works
These Guidelines apply to derivative works of the following works (hereinafter collectively referred to as the "Content") and to the official character "DAJI" and related still images for which the Company holds exclusive copyright.
*[Videos and music of "DAJI - AI Music Channel" published on distribution platforms such as YouTube by the Company] are excluded from the definition of the Content, and any use of them is prohibited.
In these Guidelines, "derivative works" means activities to create new works based on the Content (hereinafter referred to as "derivative works"). For example, you may not use a copy of the Content in its entirety. Publishing a copy of the Content does not constitute derivative creative activity.
Basic Policy on Secondary Creation Activities
We ask that you create derivative works of the Content with the aim of spreading its enjoyment to as many people as possible.
When creating derivative works of the contents, please do not exceed the scope of fan activities.
Recommendation of Secondary Creation Activities
We encourage the creation of derivative works of the Content. Examples of recommended works are as follows
Creation of illustrations of the Contents
Creation of manga of the Contents
Creation of novels based on the Contents
Creation of videos of the Contents
Creation of merchandise of the Contents
Production of figurines of the Contents
Creation of posters of the Contents
Creation of cards of the Contents
Creation of 3D models of the Contents
When publishing derivative works on the Internet, we request that the following information be clearly indicated
Submissions via X (formerly Twitter): Hashtag "#DAJIArt" or Mention
Submissions on illustration SNS (Pixiv, etc.): URL of "DAJI's" YouTube channel
Sale of derivative works
Distribution and sale of derivative works of the Content via the Internet and fan-created manga or comics (hereinafter referred to as "sales, etc.") are permitted as long as the activity is within the scope of a hobby. However, as mentioned above, you may not engage in such sales activities as a business that go beyond fan activities.
In addition, as a general rule, corporate entities are not permitted to use the site for any purpose other than sales. For inquiries regarding use by corporations, please contact us individually using the e-mail address at the bottom of this page. This also includes use by a corporation that bears the production costs, etc., even if the use is under the name of an individual.
If we comprehensively determine from publicly available information that the act of selling, etc. constitutes a business activity, we may prohibit the act of selling, etc.
Figurines, garage kits, and other three-dimensional objects based on illustrations related to the Content may only be sold at events for which the Company grants the copyright to the event organizer on the day of the event. Please contact the respective event organizer for details on applying for the copyright on the day of the event.
Prohibited Items for Secondary Productions
Secondary works that fall under any of the following categories are prohibited.
・Those that are mislabeled as official or that could be misunderstood or misinterpreted as official.
・Any work that misrepresents or may misrepresent the facts.
・Any work that may be detrimental to international goodwill
・Those that are offensive to public order and morals.
・Antisocial materials that are reminiscent of violence, gambling, narcotics, prostitution, etc.
・Those that may induce, encourage, or promote crimes or other violations of laws and regulations.
・Those that contain specific ideas, beliefs, religious or political content.
・Any content that uses expressions that work on the subconscious mind.
・Any contents that damage the image of the Company or the Contents.
・Items that damage the honor or dignity of a third party, or infringe on the rights of a third party
・Items that cause discomfort to a third party.
・Any other content that the Company deems inappropriate.
(e.g., recording music from the Contents, trimming a portion of the music, and transmitting it on a music sharing website, etc.)
Rights to derivative works
The Company does not waive any copyrights or neighboring rights to the Content by these Guidelines, and reserves all such rights.
By publishing a derivative work of the Content, you grant us and third parties designated by us permission to use the derivative work in the following ways, free of charge and without limitation as to location, region, or period of time.
・Derivative work will not be published or distributed via Youtube, SNS, other advertising media, or any other media without prior permission (in addition, the derivative work may be trimmed, edited, deformed, etc without impairing the identity of the work).
・Derivative work may be used in official distributions or merchandising (including digital merchandising)
(Please note that we will request permission prior to distribution or merchandising.)
Other
Disclaimer
Notwithstanding the provisions of these Guidelines, we reserve the right to request that users individually discontinue use of the Content if we deem it necessary to do so. In addition, please note that we may request the discontinuation of use of the Content on behalf of rights holders other than the Company at the request of such rights holders.
The Company assumes no responsibility for any disputes with third parties that may arise as a result of the use of the Content or the creation or posting of derivative works. These guidelines are subject to revision without notice. Please always check the latest version.
Governing Law
The laws of Japan shall be the governing law for the enjoyment of derivative works of the Content.
In the event that any dispute arises between the Company and you in relation to the derivative works of the Content, the Tokyo District Court or the Tokyo Summary Court shall have exclusive jurisdiction as the court of first instance.
